The limitations of liability set forth above are fundamental elements of the basis of the bargain between you and Cafe Rio. Some states, including New Jersey, do not allow certain limitations of liability, so some of the above limitations may not apply to you. In such states, our liability shall be limited to the fullest extent permitted by applicable law.
8. Indemnification
You agree to defend, indemnify, and hold harmless Cafe Rio, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, contractors, licensors, service providers, subcontractors, and successors from and against any and all claims, liabilities, damages, losses, judgments, awards, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or relating to:

The arbitrator's award shall be final and binding, and judgment on the award rendered may be entered in any court having jurisdiction thereof. The arbitrator shall have authority to award any remedies that a court of competent jurisdiction could award, but the arbitrator's authority is limited to the individual parties and their individual claims.
10.3 Class Action Waiver
YOU AND CAFE RIO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Cafe Rio agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. If this class action waiver is found to be unenforceable, the arbitration provision shall be null and void.
10.4 Exceptions to Arbitration
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights, copyrights, trademarks, trade secrets, or other proprietary rights.
10.5 Small Claims Court
Either party may also elect to have a dispute heard in small claims court, provided the claim qualifies under the applicable small claims court rules and the dispute is within the court's jurisdiction.
11. Term and Termination
